Agency: Etienne International Agency, located Siddelingeplein 198 in Rotterdam, The Netherlands.
Client: Any individual or organization engaging the services of the Agency.
Candidate: Any individual seeking employment opportunities through the Agency.
Agreement: Any contract between the Agency and the Client for the provision of recruitment services.
Applicability These General Terms and Conditions apply to all offers, assignments, and agreements between the Agency and the Client, as well as to all services provided to Candidates. Deviations from these terms are only valid if expressly agreed upon in writing by both parties.
Services
Recruitment and Selection: The Agency assists Clients in recruiting and selecting suitable Candidates for employment positions.
Executive Search: The Agency conducts targeted searches for executive and senior-level positions.
Interim Management: The Agency provides Clients with temporary management solutions.
Client Obligations
Information Provision: Clients must provide accurate and complete information regarding job vacancies, including job descriptions, requirements, and employment conditions.
Confidentiality: Clients shall maintain the confidentiality of all Candidate information provided by the Agency.
Fee Payment: Clients agree to pay the Agency’s fees as outlined in the Agreement.
Candidate Obligations
Accuracy of Information: Candidates must provide truthful and accurate information regarding their qualifications, experience, and employment history.
Confidentiality: Candidates shall maintain the confidentiality of any proprietary information obtained through the recruitment process.
Fees and Payment
Fee Structure: The Agency’s fees are outlined in the Agreement and are subject to VAT as per Dutch law.
Payment Terms: Invoices are payable within 14 days of the invoice date unless otherwise agreed upon in writing.
Late Payment: In case of late payment, the Client is liable for statutory interest and any collection costs incurred by the Agency.
Liability
Agency Liability: The Agency is not liable for any damages arising from the actions or omissions of Clients or Candidates.
Limitation of Liability: The Agency’s liability is limited to the amount received as a fee for the specific service provided.
Confidentiality and Data Protection The Agency complies with the General Data Protection Regulation (GDPR) and other applicable Dutch privacy laws. Personal data collected will be used solely for recruitment purposes and will not be disclosed to third parties without consent.
Intellectual Property All content on the Agency’s website, including text, graphics, logos, and images, is the property of the Agency and is protected by intellectual property laws. Unauthorized use is prohibited.
Termination Either party may terminate the Agreement with immediate effect if the other party breaches any material obligation and fails to remedy such breach within 14 days of receiving written notice.
Governing Law and Jurisdiction These Terms and Conditions are governed by Dutch law. Any disputes shall be brought before the competent court in Rotterdam, The Netherlands.
Amendments The Agency reserves the right to amend these Terms and Conditions at any time. Changes will be posted on the Agency’s website, and continued use of the Agency’s services constitutes acceptance of the amended terms.
